Legal

Most legal problems in this market are structural. They are created at set-up and discovered under pressure.

Preventative: succession, asset protection, contracts. Contentious: disputes already in court — and the exposure that shows itself only under pressure.

Succession

Why Succession Is Urgent Here

A UAE owner typically holds assets that do not pass automatically: shares in a UAE company, a property, a bank account, sometimes assets in a second or third country. Where no valid will is in place, distribution follows default rules that may not match expectation — and in the interim, accounts can be frozen and a business left without anyone authorised to operate it.

The practical consequence is usually not a dispute over the eventual outcome. It is the months in which nobody can sign for the company, pay staff, or access the account, while the family is also dealing with everything else.

A will is inexpensive relative to what it protects. It is the clearest example of work that costs a little now or a great deal later.

Complications

Where It Goes Wrong

No will, or a will that does not cover UAE assets

A will drawn up abroad may not be effective here, or may require a recognition process at the worst moment.

Shareholder arrangements never documented

Two founders start with an understanding. It works until it does not — and by then the company, the customers and the bank account are all in one name.

Contracts signed in the wrong name

Signed personally instead of by the company, or by an entity whose licensed activity does not cover the work. This surfaces during a dispute, when it matters most.

Assets held personally without thought

Property, shareholdings and business assets held directly, with no separation between operating risk and family wealth.

Disputes escalated before they are documented

Position, evidence and jurisdiction should be established before a matter becomes contentious, not during.

FAQ

Questions

Do I need a UAE will if I already have one at home?

Usually yes, for UAE assets. A foreign will may not be directly effective here and may require a recognition process, which takes time precisely when time is short.

What happens to my company if I die without one?

Shares form part of the estate and pass under whichever rules apply. Until that is resolved, there may be nobody with authority to operate the company or its bank account.

What is a foundation used for?

Consolidating ownership of assets, providing continuity irrespective of what happens to any individual, planning succession without probate, and separating family wealth from operating risk.

Can you act for me in court?

We prepare and file cases and arrange representation before UAE courts, and we tell you at the outset what a matter realistically involves in time and cost.

Can you review a contract someone has sent me?

Yes. Review before signature is materially cheaper than argument afterwards.

Is this only for large estates?

No. The consequence of having no will falls hardest on ordinary families, because the frozen account and the unoperated company affect them immediately.
